AUFKLÄRUNG, GERECHTIGKEIT, ENTSCHÄDIGUNG

Wie ist es möglich, dass ein Mensch in einer Gefängniszelle im sogenannten „Sicherheitsgewahrsam“ verbrennt und die Todesumstände seit bald 2 Jahren ungeklärt bleiben? Die offenen Fragen zu dem Todesfall Oury Jallohs sind zahlreich und erschreckend.

Umso unfassbarer ist die bislang fehlende Aufklärung von Seiten der Staatsanwaltschaft und die Behinderungen durch das Landgericht Dessau.

Am 7.1. 2005 wurde Oury Jalloh von der Dessauer Polizei in „Schutzhaft“ genommen, wo er in einer Gewahrsamszelle an Händen und Füßen an Wand und Boden „fixiert“ qualvoll verbrannte.

Am 6.5.2005 hat die Staatsanwaltschaft Dessau gegen 2 Polizeibeamte Anklage erhoben, wegen Körperverletzung mit Todesfolge gegen den einen und fahrlässiger Tötung gegen den anderen.

Im November 2007 ließ das Gericht die Anklage gegen den einen Polizisten fallen. Begründung: Er sei nicht für die Durchsuchung Oury Jallohs zuständig gewesen, bei der er angeblich ein Feuerzeug übersehen haben soll.
Die Staatsanwaltschaft und die AnwältInnen der Nebenklage haben eine Beschwerde gegen das Fallenlassen der Anklage eingereicht.

Nach fast 2 Jahren seit dem Tod Oury Jallohs und über eineinhalb Jahre nach der Anklage durch die Staatsanwaltschaft wird durch Beschluss des Landgerichts Dessau vom 2.1.07 nun die Anklage gegen den Dienstgruppenleiter zugelassen. Das Verfahren gegen ihn wegen Körperverletzung mit Todesfolge durch Unterlassung wird vor dem Landgericht Dessau - Schwurgericht - stattfinden.

Für den Prozess sind zur Zeit zwanzig Verhandlungstage angesetzt:

How is it possible that a human being can lose his life in a jail cell, burned alive in a so-called ’security tract’, and the circumstances regarding his death remain a mystery two years later? The unanswered questions regarding Oury Jalloh’s death are as numerous as they are shocking.

Even more unfathomable, however, is the complete lack of clarification on the part of the State Prosecutor and the obstructions of the District Court of Dessau.

On the 7th of January, 2006, Oury Jalloh was taken into ‘protective detention’ by the Dessau Police, where he die an excruciating death; burned alive while ‘fixed’ at his hands and feet to the wall and floor.

On the 6th of May, 2005, the State Prosecutor of Dessau formally filed charges against two police officers, one for bodily harm resulting in death and the other for negligent homicide. All other possibilities have been excluded from the State Prosecutor’s accusation.

Nearly 2 years since Oury Jalloh’s death and more than one and half years after accusation by the State Prosecutor the Court accepted to take on the case at the 2nd january 2007 against one of the policemen. The court case will take Place in Dessau - Schwurgericht.

Comment est il possible qu´un homme qui est détenu, pour une prétendue «garde à vue pour raisons de sécurité », meurt brûlé dans sa cellule et que les circonstances de sa mort ne soient pas éclaircies depuis presque 2 ans? Les questions non élucidées en ce qui concerne la mort d´Oury Jalloh sont nombreuses et effrayantes.

Il est d’autant plus inconcevable qu´il manque jusqu’ici l´élucidation de la part des avocats généraux et que le tribunal de grande instance de Dessau entrave plutôt les enquêtes.

Le 07.01.2005 Oury Jalloh était arrêté et mis en « détention pour raisons de sécurité » par la police de Dessau où il est mort brûlé dans d’atroces souffrances dans une cellule de garde à vue, pendant qu´il était fixé avec ses mains et ses pieds au mur et au sol.

Le 06.05.2005 l´avocat général de Dessau a engagé des poursuites contre deux policiers pour coups et blessures entraînant la mort pour l’un, et homicide involontaire pour l’autre. Toutes autres possibilités sont déjà exclues dans l´inculpation.
